Terms of Service

The service

FIMIT lets you capture 3D LiDAR scans of indoor spaces on iOS and manage, view, measure and export the resulting models and floor plans through the web dashboard. Features depend on your subscription plan.

Your account

You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account and for the users you invite into your organization. Tell us immediately if you suspect unauthorized access.

Acceptable use

You agree not to:

• Use FIMIT unlawfully, or to scan spaces or people without the rights or consent to do so.
• Attempt to break, overload, reverse-engineer or gain unauthorized access to the service.
• Resell or misrepresent the service, or upload malicious or infringing content.

Subscriptions, billing and taxes

Paid plans are billed in advance for the period shown at checkout and renew automatically until cancelled. Prices are shown excluding VAT; applicable VAT/tax is calculated and added at checkout based on your billing location. A free trial, where offered, is not charged during the trial period. You authorize us (via Stripe) to charge your payment method for each renewal until you cancel.

Cancellation and refunds

You can cancel auto-renewal at any time; your plan then stays active until the end of the period already paid for, and you are not charged again.

For paid subscriptions we generally do not refund partial or unused periods, except where required by law. EU consumers have a 14-day right of withdrawal for digital services; by starting a paid subscription and requesting immediate access you ask us to begin performance right away and acknowledge that the withdrawal right is lost once the service has been fully supplied. The free-trial period exists so you can evaluate the service before being charged. If you believe you were billed in error, contact us and we will deal with it fairly.

Your data and intellectual property

You own the scans, floor plans and content you create. You grant us the limited licence needed to host, process and display that content in order to provide the service to you (for example converting a scan into a viewable model and floor plan). We own the FIMIT software and brand. Our handling of personal data is described in the Privacy Policy.

Availability and warranties

We work to keep FIMIT available and accurate, but the service is provided "as is" without warranties of any kind. Measurements and generated plans are estimates produced from sensor data and should be verified before being relied on for construction, legal or safety purposes.

Limitation of liability

To the maximum extent permitted by law, FIMIT is not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.

Termination

You can stop using FIMIT and delete your account at any time. We may suspend or terminate access for breach of these Terms or where required by law. On termination your data is handled as described in the Privacy Policy.

Changes to these terms

We may update these Terms as the service evolves; we will post the new version with an updated date and notify you of material changes. Continued use after a change means you accept it.

Governing law

These Terms are governed by the laws of Spain, and disputes are subject to the competent courts of Spain, without affecting any mandatory consumer-protection rights you have where you live.
